In Australia, the “TM” trademark symbol is an indication to the world that you consider what you’re using it on the be a trademark. However, that does not legally make it so. An ® trademark symbol, on the other hand, can only be used on an officially registered trademark and it is an offence to use it on something that’s not registered.
